SMS Consent and Verbal Opt-In Process

Program Overview
Damascene Labs operates the “Damascene Labs Appointment Notifications” SMS program to send informational text messages about appointments scheduled through Theo, our AI voice agent. This program sends appointment-related notifications only. It does not send advertising or promotional marketing messages. This page documents the verbal consent process Theo and our authorized representatives use to enroll callers in this program.
Types of Messages
Callers enrolled in the program may receive:
- Appointment request acknowledgments
- Appointment confirmations
- Appointment reminders
- Rescheduling notifications
- Cancellation confirmations
Who May Opt In
Only the person who provides verbal consent during a live phone call with Theo, or with an authorized Damascene Labs or business-customer representative, may be enrolled in the program, and only for the mobile number used on that call. Enrollment is always tied to the specific call in which consent was given.
Exact Verbal Disclosure
Before enrolling a caller in the SMS program, Theo or the authorized representative reads the following disclosure aloud, in full, and asks the caller to respond:
“Would you like Damascene Labs to send appointment request acknowledgments, confirmations, reminders, rescheduling updates, and cancellation notifications to this mobile number? Message frequency varies based on your appointment activity and is typically between one and four messages per appointment. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time. Your consent is optional and is not required to use the scheduling service. Our Terms and Conditions are available at damascenelabs.com/terms, and our Privacy Policy is available at damascenelabs.com/privacy. Please say yes or no.”
Explicit Yes-or-No Consent
Theo or the authorized representative must obtain an explicit “yes” from the caller before enrolling them in the SMS program. Silence, an unclear or ambiguous answer, or the caller simply providing a telephone number is not treated as consent. If the caller says “no,” or gives an unclear answer, the scheduling process continues normally without SMS enrollment: the caller is not enrolled, and no appointment notifications are sent to their number. No SMS appointment notifications are sent unless affirmative consent has been recorded.
Enrollment Confirmation
When a caller says “yes,” Theo or the authorized representative confirms enrollment verbally, using the following language:
“Thank you. You are enrolled in Damascene Labs appointment notifications. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out.”
How Consent Is Recorded
When a caller provides affirmative consent, Damascene Labs records, at minimum:
- The mobile number provided
- The date and time consent was given
- The consent method (verbal, during a live call)
- The specific messaging program (Damascene Labs Appointment Notifications)
- The version of the disclosure that was presented to the caller
- The caller's affirmative response
- The appointment or interaction associated with the consent, when applicable
These records are kept internally to demonstrate compliance with applicable messaging regulations and are not displayed on this public page.
How to Opt Out
Anyone enrolled in the program may opt out at any time by replying STOP to any message they receive. Opting out stops future SMS appointment notifications. It does not cancel any existing appointment, and it does not prevent access to Theo or the underlying scheduling service through other available means.
